PATIENT RIGHTS: NOTICE OF RIGHTS

Based on document review and interview, in six (6) of 6 patients interviewed, the facility failed to ensure that each patient received a notice of their rights as hospital patient in advance of furnishing care (Patient #s 2, 3, 4, 5, 6 and 7).

Findings include:

On 02/09/2022 at 11:00 am, during the tour of the Emergency Department, Patient #2 when asked how she was notified of her rights as a hospital patient, the patient stated she did not receive a verbal or written notice of her rights.

Similar responses were given by Patient #s 3, 4, 5, 6 and 7 during their interviews.

On 02/09/2022 at 11:05 am, Staff A (AVP of Operations) stated that patients are given a Bill of Rights booklet upon admission to the inpatient unit.

On 02/09/2022 at 11:10 am, Staff I (Director of Patient Experience) stated that patients are given a one-page document of Patients' Bill of Rights during registration in the Emergency Department.

Review of the policy titled, "Patients' Bill of Rights/Patient Responsibility and Parents' Bill of Rights Policy Statement," last revised on 11/2018 revealed "Copies of Your Rights as a Hospital Patient in New York State' handbook is distributed through the Admitting Department, Emergency Department Registration, and inpatient units."

On 02/10/2022 at approximately 3:30 pm, these findings were acknowledged by Staff B (AVP Emergency Services), Staff L (Director of Regulatory Affairs), and Staff M (Assistant Director of Regulatory Affairs) during the exit conference.
