PATIENT RIGHTS: FREE FROM ABUSE/HARASSMENT

Based on document review and interview, it was determined that for 1 of 4 (Pt. #1) clinical records reviewed for allegation of abuse. The Hospital failed to ensure the incident of an allegation of abuse was reported to the Illinois Department of Public Health in accordance with applicable local, State or Federal law.
Findings include:
1. On 09/14/2021, at approximately 10:00 AM, the clinical record of Pt. #1 was reviewed. Pt. #1 was admitted to the Hospital on 07/26/2021, with a diagnosis of COPD (chronic obstructive pulmonary disease). Pt. #1 was discharged home on 08/07/2021.
2. On 09/14/2021, at approximately 3:00 PM, the Hospital's document titled, "Event Reporting System #MQB2626626" dated 08/02/2021 at 4:41 PM was reviewed and included, "Feedback Received: 08/02/2021 - 12:45 PM ...Staff attitude and Behavioral Issues, Aggressive (Physical) Behavioral Issue, Staff as Aggressor ...Security Staff ...Date and time of issue: Unknown ...On the evening of 08/01/2021, this patient [Pt. #1] claims that she was abused by security staff ...On the evening of 08/01/2021 ..."
3. On 09/15/2021, at approximately 9:00 AM, the Hospital's policy titled, "Allegations of Patient Abuse by Personnel in the Hospital" dated 08/16/2021, was reviewed and included, " ...Notification to State Agencies within 24 hours ...1. On the same day that the allegation or report of Abuse is received ...Risk Management will coordinate a conference ...to make determination if the incident is required to be reported to the State ... 2. Reports or allegations of possible Abuse ...will generally be reported to the Illinois Department of Public Health (IDPH) within 24 hours or receipt ..."
4. On 09/15/2021, at approximately 9:30 AM, the Risk Manager (E #15) along with Director of Nursing (E #16) were interviewed. E #15 stated that the allegation of abuse was not reported because an investigation was conducted within 24 hours and there was no reasonable cause that abuse occurred. E #15 and E #16 stated that the alleged abuse incident from Pt. #1 was not reported to the Illinois Department of Public Health (IDPH), due to being investigated by the Hospital and was unfounded.
