Based on record review and interview, the hospital failed to comply with applicable state laws by failure of the hospital to use the State's designated repository (The Louisiana Office of State Police, Bureau of Criminal Identification and Information) for criminal history information pursuant to the laws cited La R.S.15: 575 on the non-licensed personnel prior to employment for 3 (S1MHT, S2MHT, S3MHT) of 3 non-licensed personnel records reviewed from a total of 3 personnel records reviewed.

Findings:

Effective June 2, 2016, Act 311 amended La RS 40:1203.1-2 requiring that licensed health care providers shall request that a criminal history and security check be conducted on the non-licensed person, prior to any employer making an offer to employ or to contract with a non-licensed person or any licensed ambulance personnel to provide nursing care, health-related services, medic services, or supportive assistance to any individual and in accordance with La RS 40:1203.1-5.

Review of the personnel records for S1MHT, S2MHT and S3MHT revealed no documented evidence of a criminal background history check by an agency approved by the Louisiana State Police.

An interview on 10/18/2022 at 2:15 p.m. with S4HR confirmed that the agency used to conduct criminal background checks was not included on the LSP authorized agency list as an LSP approved agency.
