PATIENT RIGHTS: RESTRAINT OR SECLUSION

Based on medical record review, document review and interview, an order from a physician or licensed independent provider (LIP) for the use of restraint was not obtained in 1 of 7 patients (Patient #1).

Findings Include:

Review of policy TX.10 - Restraints - issued 5/7/01 revealed that when restraints are initiated in an emergent situation, an order must be obtained either during the emergency application of the restraint or immediately after the restraint is applied. This policy defines restraint is any method of physically or chemically restricting a person's freedom of movement...

Review of the medical record for Patient #1 revealed a nursing note dated 8/17/19 at 10:44 AM stating that security came to the floor and physically restrained the patient.

Interview with Staff (D) and (E), Security Officers on 10/2/19 revealed that on 8/17/19 they physically held Patient #1 by the arms and legs until law enforcement arrived due to the patient's erratic behavior.

Review of the medical record for Patient #1 revealed no physician or LIP order following the application of physical restraint on 8/17/19.

Based on document review and interview, the facility does not provide restraint training for security personnel.

Findings Include:

Review of policy TX.10 issued 5/7/01 revealed training requirements of clinical support staff (UAP's - Unlicensed Assistive personnel) should have restraint training on orientation and annually thereafter.

Review of personnel files for Staff (D) and (E), Security Officers, on 10/3/19 revealed no evidence of training related to the use of restraints or physical holds.

Interview with Staff (D) and (E), Security Officers, on 10/2/19 revealed they do not receive restraint training or training related to proper holds with a combative individual. They did report, that while they don't apply mechanical restraints(ties, vest, ect), they do hold a persons' extremity as directed by staff so medical personnel can apply such devices.

Interview with Staff (P), Security Manager, on 10/3/19 verified the above findings.
