PATIENT RIGHTS: CARE IN SAFE SETTING

Based on medical record review, facility policies review, and staff interviews, it was determined that patient's rights were violated. Physician orders for "Room Lockout" extended beyond the time unit programming was offered at the facility.

Findings included:

TAC §404.166. states in part:
"Restriction of Rights as Part of Non-Emergency Behavioral Interventions.
(a) Patient rights are guaranteed under the provisions of this subchapter. Although under special circumstances set out in this subchapter, certain rights can be limited without informed consent, it is usually mandatory and always preferable to obtain informed consent when limitation of rights is contemplated.
(b) Except as otherwise noted in this subchapter, written informed consent must be obtained when a right guaranteed by law or department rule is limited.
(1) The patient or legally authorized representative gives informed consent.

Review of Sunrise Canyon Hospital unit programming schedule showed all groups/classes ended at 4PM. The order placed for "Room Lock Out" extended the restriction beyond what was necessary, as there was no scheduled programming after 4PM.
The Physician Order written by the Physician Assistant (PA) on 02/18/19 at 0945 stated, "Room Lockout 8am to 8pm M-F due to isolation & lack of participation."

In an interview with the Staff #5, she stated, "order for Room Lock Out from 8am to 8pm M-F was also for staff to observe the patient because patient was not compliant with treatment for her diabetes."

The above findings were confirmed by staff #5 on the afternoon of 10/09/19.

TREATMENT DOCUMENTED TO ASSURE ACTIVE THERAPEUTIC EFFORTS

Based on medical record review, facility policies review, and staff interviews, it was determined the facility failed to protect patient rights. No documented evidence of staff attempting to care for the patient in a less restrictive setting prior to Room Lockout restriction.

Findings included:

Review of the patient's Treatment Plan Date 02/18/19 11:48 AM, Client Problem 6 stated "Room Lockout for avoiding daily routine and participation in hospital program as evidenced by patient again in her room and isolating except for meals.
No documentation by staff was observed of staff attempting to care for the patient in a least restrictive setting.
