Based on review of facility documents and staff interview (EMP), it was determined that the facility failed to have written policies and procedures available to meet the needs of patients with emergency medical conditions if it elects to permit on-call physicians to schedule elective surgery during th time that they are on call or to permit on-call physicians to have simultaneous on-call duties.

Findings include:

Review of facility policy "Emergency Medical Treatment and Transfer Policy (EMTALA)" dated "January 2012" on March 21, 2012, at approximately 1:30 PM, revealed, "...D. On-Call Rotation Responsibilities See the Rules and Regulations of The Medical Staff..."

Review of "Medical Staff Bylaws, Policies, and Rules and Regulations of The Washington Hospital" dated, January 25, 2011, on March 21, 2012, at approximately 1:30 PM, revealed, "...2. Response to Call when an on-call physician is contacted by the Emergency Department or by a Patient Care Unit the physician must respond to the Emergency Department to Patient Care Unit within 30 minutes of receiving the call. 3. If there is an emergency and he attending practitioner is unavailable, another member of the Staff may be called in by an officer of the Staff or the Chief Executive Officer..."

Interview with EMP1 on March 21, 2012, at approximately 2:45 PM confirmed the above findings and revealed, "No. The bylaws do not address staff simultaneous on-call duties or on-call staff and elective surgery."

MEDICAL SCREENING EXAM

Based on review of facility documents and staff interview (EMP), it was determined that that facility failed to define, through hospital bylaws or rules and regulations, the qualified hospital staff that is to conduct the emergency medical screening examination.

Findings included:

Review of "Medical Staff Bylaws, Policies, and Rules and Regulations of The Washington Hospital" dated, January 25, 2011, on March 21, 2012, at approximately 1:30 PM, revealed that the bylaws do not provide information regarding who may conduct the Emergency Medical Screening Examination.

Interview with EMP1 on March 21, 2012, at approximately 4:00 PM revealed, "No, the bylaws do not specifically address who can complete a medical screening... "
