Based on Medical Record (MR) review, review of facility policy and procedure, and interview with staff (EMP), it was determined the facility failed to provide Medicare beneficiaries with appropriate notice of rights as evidence by lack of a signed "Important Message from Medicare" for six (6) out of six (6) medical records reviewed (MR6, MR7, MR8, MR9, MR10, MR11).
Review of MR6 on January 10, 2024, revealed that the "Important Message from Medicare" notice was not found in electronic medical record for admission from November 20 to November 25, 2023.
Review of MR7 on January 10, 2024, revealed that the "Important Message from Medicare" notice was not found in electronic medical record for admission from November 30 to December 18, 2023.
Review of MR8 on January 10, 2024, revealed that for patient's current admission from January 4, 2024, the "Important Message from Medicare" was noted to have been scanned into the electronic medical record on January 10, 2024, at 12:56 PM.
Review of MR9 on January 10, 2024, revealed that the "Important Message from Medicare" notice was not found in electronic medical record for admission from November 15 to November 19, 2023.
Review of MR10 on January 10, 2024, revealed that the "Important Message from Medicare" notice was not found in electronic medical record for admission from August 13 to August 16, 2023.
Review of MR11 on January 10, 2024, revealed that the "Important Message from Medicare" notice was not found in electronic medical record for admission March 23 to March 26, 2023.
Review on January 10, 2024, of hospital policy, "Medicare", dated June 1, 2022, revealed, " ...IMM must be completed between 24-48 hours or two calendar days of the first day of admission ... Provided a copy of the Important Message from Medicare (IM, FORM CMS-10065) to the parent/guardian no earlier than 2 days prior to discharge ... "
Interview on January 10, 2024, at 1:45 PM with EMP1 confirmed the "Important Message from Medicare" notice was not found in electronic medical record for admission in MR6, MR7, MR8, MR9, MR10, MR11.
