Based on staff interview, record review, and review of the facility submitted disclosure statement self-disclosing an Emergency Medical Treatment and Labor Act (EMTALA) violation, the facility failed to complete assigned mandatory current and long term education and training.
Findings Include:
During an interview with the Chief Nursing Officer (CNO) on April 23, 2021 at 09:35 AM, CNO stated that the facility assigned a mandatory current and long term education and training EMTALA course on their online training platform for all Emergency Department (ED) staff.
On April 23, 2021 at 12:00 PM, the facility provided a list of ED staff that completed the EMTALA course. A review of that list found that six (6) ED staff did not complete the assigned mandatory EMTALA course.
On April 23, 2021 at 12:40 PM, a review of the facility submitted disclosure statement self-disclosing the EMTALA violation stated that the facility did the following: Action Taken, Current and Long Term Education and Training. Wilcox Leadership impressed on all ED staff that appropriate triage - including vital signs and initial assessment - must be conducted, and Medical Screening Examination (MSEs) are required, for all ED patients who seek emergency medical treatment and also all EMTALA transfer requirements - including (but not limited to) acceptance by the receiving facility. A. Online EMTALA training for all ED personnel with: a. Mandatory participation by ED staff and physicians, b. One-hour online course offered through internal online learning center, c. All assigned employees had 90 days to complete course assigned on 12/15/20 which required successful completion of a post test. As previously mentioned, six (6) ED staff did not complete the assigned mandatory EMTALA course.
