Based upon observations of the stairway construction the fire rating of the stairway is not maintained to provide the required fire resistance rating when the building was built.

Findings Include:

During construction inspections of the 6th floor on 03-28-2013 between 9:00 a.m. and 12:00 p.m. it is observed that the south east stairway and vestibule are shown on drawings to be fire rated fire barrier for four hours. There are gaps at the top of the wall that is not fire stopped with a listed design and product to provide the required four hour fire resistance rating. There is missing or damaged fire proofing of the structural steel that supports the stairway and vestibule fire barrier walls.
