PATIENT RIGHTS: NOTICE OF GRIEVANCE DECISION

Findings:

Based on review of records and interview, the hospital failed to provide written notice of its decision, steps taken, results of the investigation and date of completion to 6 of 6 grievances received from patients (Patient #1,16,18, 19, 22 and 24) regarding patient care complaints.

Patient #1 complained to the facility on 12/27/09 about being treated rudely by staff, abuse, performing experimental procedures on her without consent and being discharged home with needles in her arm.

Patient #16 complained to the facility on 12/18/09 that she received two doses of the H1N1 vaccines accidently and was concerned about the safety of her pregnancy.

Patient #18 complained to the facility on 11/16/09 that he was prescribed some medication that caused him to have a heart attack. He also reported that he was in need of an electric wheelchar and his provider won't help.

Patient #19 complained to the facility on 12/09/09 that she did not understand that her tubal ligation on 11/16/09 was not a permanent procedure for contraception and complained that an interpreter was not used during the consent process.

Patient #22's husband complained to the facility on 05/11/10 that his wife has had numerous admissions but she still remains in constant pain, vomit's 5-20 times per day, has lost over 20 pounds and is not getting better.

Patient #24's mother complained to the facility on 12/23/09 that the physician wanted her to sign forms to take her son off the machine but she did not want to because she wanted to see if he was going to recover. Physician told mother that her son was going to die anyway and she did not know how much this was costing.


Administrative Policy, " Patient Complaint and Grievance Policy, " revised, 11/09, requires under, " The person responsible for the complaint resolution shall communicate in writing the outcome of the investigation with the complainant, and must have evidence of the communication on file..."

In an interview with Personnel #5, Manager of Patient Relations, on the afternoon of 06/08/10, she was asked if a written notice of the hospitals decision that contained the required components of the grievance process was provided to Patient ' s #1, 16, 18, 19, 22, and 24. She stated, " No. "
