Based on review of background information, other information provided and interviews with key staff on August 21 and August 27, 2014, it was determined that the facility failed to ensure that all patient care services were furnished in accordance with applicable State laws.

Findings include:

1. The Maine State Board of Pharmacy, Maine Certification Authority, Pursuant to Board Rules Chapter 11, Section 1 (D)(2), states that for corporations not organized under Maine laws, a certification authorizing an out-of-state company to do business within the State of Maine is required.

2. In June 2014, The Maine State Board of Pharmacy provided the Division with documentation that MED PRO Distributors, a pharmaceutical company based in North Carolina, had supplied Mount Desert Island Hospital with pharmaceutical supplies. The documentation further indicated that this company was not licensed as a vendor in the State of Maine.

3. On August 27, 2014, at 1:33 p.m., a telephone interview was conducted with the Vice President, Chief Financial Officer (CFO) at Mount Desert Island Hospital (MDI Hospital). She stated that MDI Hospital had made four (4) purchases from MED PRO Distributors in January and February 2013. She further stated, that at that time, the Director of Pharmacy had no process to check on the licensure of vendors. The CFO stated that as of February 2013, when the new Director of Pharmacy came on board, a process was developed to always check on the licensure of vendors before an order was placed.
