Based on record review and interview, the facility failed to provide the patients with the right to chose their own attending physician for 3 of 3 (#5, #6, and #8) swing bed patients.
Findings:

Review of patient #5's, #6's, and #8's record revealed the three patients were seen by the same attending physician.

Review of the facility's staffing list revealed the facility has a Physician Assistant and one attending physician during the time these patients were admitted in to the hospital.

Interview with the Chief Executive Officer on 10/18/2012 at 3:55 PM revealed that the facility only has one physician.

Based on record review and interview, the facility failed demonstrate that they have provided three of three (#5, #6, and #8) swing bed patients a written the reasons for their transfer.

Findings:

1. Review of patient #5's record revealed a social service entry dated 10/10/12 at 1415 that stated that the patient's son wanted the patient home when she is medically stable. Further review of the entry revealed that the social worker provided the son with support and discharge planning. Further review of this record failed to reveal that the facility had provided the patient or the patient's spouse with a written reason for the transfer.

2. Review of patient #6's record revealed the patient #6 was discharged on 10/14/12 at 12:05 PM to a long term care hospital. Further review of this record failed to reveal that the facility had provided the patient or the patient's spouse with a written reason for the transfer.

3. Review of patient #8's record revealed a Social Service note dated 10/10/12 at 10:30 which indicates that the writer spoke to patient #8's husband to discuss discharge planning. Another entry for this date at 1430 indicates that the writer contacted a named skilled nursing facility (SNF) for a referral and left a message for the Admission Coordinator. Entry dated 10/15/12 at 1100 revealed that the writer made 2 referrals to two named SNFs. The entry further stated that the patient's spouse went to both facilities, but neither had available beds. Further review of this record failed to reveal that the facility had provided the patient or the patient's spouse with a written reason for the transfer.

4. On 10/17/12 at 11:15 AM, the Registered Nurse (RN) in Charge was overheard contacting Skilled Nursing Facilities looking for placement for residents #5 and #8.

Interview with the RN in charge on 10/17/12 at 11:35 AM revealed she has been looking for placement for residents #5 and #8 because she was instructed to do so. She further stated that the Social Worker was in the facility on Monday 10/15/12, but has not returned. She further stated that she could not answer the surveyor's questions regarding discharge because the Social Worker was working on that and she was just told to contact facilities for placement.
