Based on documentation review and interview, the facility failed to ensure that 2 of 2 involuntary patients were made aware of their rights.
Findings included:
Review of the medical record revealed Patient #5 was admitted on 11/24/16 on an emergency detention. The admission form titled, "Patient Rights and Responsibilities" dated 11/24/16 did not contain a signature for Patient #5. The Director of Nursing, Staff #1 and the Nurse Manager, Staff #2 agreed the above patient rights were not signed by Patient #5.
Review of the medical record revealed that Patient #10 was admitted on 12/2/16 on an emergency detention. The admission form titled, "Patient Rights and Responsibilities" dated 12/2/16 did not contain a signature for Patient #10. The hospital form titled "Patient's Bill of Rights" did not contain a dated signature of Patient #10. The Director of Nursing, Staff #1 and the Nurse Manager, Staff #2 agreed the above patient rights forms were not signed by Patient #10.
Facility document titled, "Patient Bill of Rights" stated, in part, "Statement that you have received this pamphlet and that it has been explained
___ I certify, that, staff have explained its content to me in a language I understand within 24 hours of admission (if involuntarily committed).
___ I certify, that, staff have explained its content to me in a language I understand prior to Admission (if voluntarily committed)."
The above findings were confirmed in an interview with Staff #1 and Staff #2 the afternoon of 12/27/16 in the facility conference room.
