Based on policy review, document review and interview, the facility did not protect Patient #2's right to privacy.
Findings include:
Review on 12/9/20 of "The Human Resources Guide Standard Operating Procedures & Policies" revealed unauthorized use of a personal cell phone to record sound, video, or take stills (pictures) of the facilities, patients, visitors, or other employees, is strictly prohibited.
Review on 12/9/20 of the facility complaint dated 9/28/20 revealed the complainant provided the facility with a copy of a video taken by one of security guards on their personal cell phone. The cell phone video is from the facility
" camera video feed." The facility concluded that Staff (H), Security Officer, did use his personal cell phone to copy a facility video in order to complete his report.
Interview on 12/9/20 with Staff (H), Security Officer confirmed that he used his personal cell phone to record the facility video on 9/25/20 to write up his reports. He forgot to delete the video after he was done viewing it.
Interview on 12/9/20 with Staff (B), Senior Manager, and Staff (Q), Senior Director of Safety verified these findings.
