Based on review of clinical contracts and interviews, the governing body failed to ensure that there was oversight of all contracts with Temporary Nurse Agencies (TNAs) to ensure the agencies were registered and legally able to provide services in the State of Maine for 1 of 4 contracts reviewed (TNA #1).
Finding:
On 4/11/19, surveyors asked to review the contracts of all TNAs that the hospital contracted with.
On 4/12/19, a review of four (4) Temporary Nurse Agency staffing contracts for the hospital was conducted and revealed that a contract with TNA #1 did not mee the State of Maine statutory requirement to register as a TNA in the State of Maine.
On 4/12/19, a review of the TNAs in the State Of Maine system revealed TNA #1 was not registered.
On 4/12/19 at 2:50 PM, this finding was reviewed with the System General Counselwho stated that it was the Talent Acquisition Coordinators responsibility to validate the TNAs were approved to operate in the State of Maine.
On 4/12/19 at 3:30 PM, a list was obtained that indicated four Nurses were currently worked at the hospital and were employed through the TNA #1.
