Based on clinical record review, it was determined the Facility failed to ensure 3 (#3, #5 and #20) of 20 (#1-#20) Medicare patients did not have signed Medicare Important Notices in the clinical record. Failure to ensure issuance of the Medicare Important Notice did not allow the patients the opportunity to be informed of and aware of their rights as a hospital patient, as well as their discharge and appeal rights. The failed practice affected 2 patients on the day of survey and had the potential to affect all Medicare patients admitted to the facility. Findings follow:
A. Review of the open clinical records of Patient #3 and Patient #5 revealed no Medicare Important Notices in the clinical records. Findings verified by the Rehabilitation Director at 1335 on 02/24/12.
B. Review of the closed clinical record of Patient #20 revealed no Medicare Important Notices in the clinical records. Findings verified by the Rehabilitation Nurse Manager at 1400 on 02/24/12.
