Based on medical record review and interview the facility failed to ensure that 8 of 8 patients with Medicare (#1, #5, #6, #7, #9, #10, #11 and #12) received a copy of the Important Message from Medicare (IMM) resulting in the potential failure of the patient or the patient's power of attorney (POA) the ability to appeal discharge from the facility. Findings include:
On 3/5/15 at 0920 during medical record review of patient #1 it was revealed that the patient was admitted on 2/24/15 and didn't receive an IMM within 48 hours of being admitted.
On 3/5/15 at 1000 during medical record review of patient #5 it was revealed that the patient was admitted on 2/21/15 and didn't receive an IMM within 48 hours of being admitted.
On 3/5/15 at 1020 during medical record review of patient #6 it was revealed that the patient was admitted on 2/17/15 and didn't receive an IMM within 48 hours of being admitted.
On 3/5/15 at 1045 during an interview with staff A, when queried if patient #1, #5 or #6 had an IMM available for review, he responded, "No."
On 3/5/15 between the hours of 1100-1300 during medical record review of patient numbered #7, #9, #10, #11 and #12 it was revealed that none of these patients received an IMM upon admission or discharge.
On 3/5/15 at 1315 during an interview with staff B, when asked if patient numbers #7, #9, #10, #11 or #12 had an admission or discharge IMM available for review, to which she responded, "No, I can't find one in their medical records."
