Based on observation and staff interview, the facility failed to post conspicuously in any emergency department or in a place or places likely to be noticed by all individuals entering the emergency department, a sign (in a form specified by the Secretary) specifying the rights of individuals under section 1867 of the Act with respect to examination and treatment for emergency medical conditions and women in labor. The facility census was 20.

Findings include:

On 07/26/21 at 1:42 PM a tour was conducted in the emergency room with Staff B and Staff I. During the tour the (EMTALA) sign was unable to be located at the main emergency room entrance informing all patients, without discrimination an appropriate medical screening exam within the capability of the emergency department must be completed to determine whether or not an emergency medical condition existed.

Staff I did locate an (EMTALA) sign posted at the entrance where patients arrived and/or were transported by helicopter. Staff B confirmed the sign would not be noticed by all patients entering the emergency room for treatment and examination. Staff B reported the (EMTALA) sign had been posted at the main emergency room entrance; however, was recently removed due to recent painting and not posted once the project was completed.
