A. Based on policy review and staff interview, it was determined that the Hospital failed to ensure compliance with A 2406.

Findings include:

1. The Hospital failed to include in the Medical Staff Bylaws Rules and Regulation a designation of individuals qualified to perform a Medical Screening Exam (MSE) in the Emergency Department (ED). See deficiency at A 2406.

A. Based on review of Hospital Medical Staff Bylaws Rules and Regulations and staff interview, it was determined that the Hospital failed to include in the Medical Staff Bylaws Rules and Regulation a designation of individuals qualified to perform a Medical Screening Exam (MSE) in the ED.

Findings include:
1. The Hospital's Medical Staff Bylaws Rules and Regulations dated 1/5/12 was reviewed on 4/17/12 at approximately 12:45 PM. The Hospital failed to include in the Medical Staff Bylaws Rules and Regulations the individual(s) designated as qualified to perform a Medical Screening Exam (MSE) in the Emergency Department (ED).

2. On 4/18/12 at approximately 3:15 PM the Chairperson of the Department of Emergency Medicine was interviewed. The Director stated, "I only hire residency trained board certified Emergency physicians or board eligible physicians that will take and pass their boards within 2 years. The physicians are trained on the EMTALA regulations while in their residency programs. We (ED physicians) do not screen patients out of the ED. We do histories and physicals on all patients and we see all the patients."

3. The finding was verified by the Chairperson of the Department of Emergency Medicine during an interview on 4/18/12 at approximately 3:30 PM.
