PATIENT RIGHTS: PERSONAL PRIVACY

Based on observations and interviews, the Hospital failed to consistently provide for patient privacy while being cared for in the Emergency Department.
Findings included:

The Surveyor toured the Emergency Department at 8.00 A.M. on 11/5/19 and interviewed the Nurse Manager. The Nurse Manager said the Emergency Department was using corridor beds because it was over capacity. The Nurse Manager said there were 36 patients awaiting beds in the Hospital.

The Surveyor observed ceiling mounted cameras scattered throughout the Emergency Department but did not observe any signage related to these cameras.

The Surveyor interviewed the Security Chief at 10:30 A.M. on 11/5/19. The Security Chief said the Emergency Department core had a number of cameras that recorded activity. The Security Chief said that the tapes were then kept for thirty days. The Security Chief said he was not aware of any signage about these cameras but was prepared to provide signs at all of the Emergency Department entrances.

PATIENT RIGHTS: RESTRAINT OR SECLUSION

Based on records reviewed and interviews, the Hospital failed to ensure that all staff involved in restraint application, monitoring or caring for a patient in restraint were CPR certified and had been educated in first aid techniques.
Findings included

The Hospital policy titled Restraint and Seclusion, approved 11/5/18, indicated that Hospital staff members who assist in applying restraints shall receive training in the use of first aid techniques and certification in the use of cardiopulmonary resuscitation.

The Surveyor reviewed two Nursing Assistants who had provided care to Patient #2 while he was restrained. Their personnel files indicated both Nursing Assistants had prior CPR certification but it was unknown whether they held current certification.

The Surveyor interviewed the Clinical Nurse Leader at 11:30 A.M. on 11/5/19. The Clinical Nurse Leader said the Nursing Assistant may be called upon to assist in restraint application and monitoring.

The Human Resource Business Partner was interviewed at 11:30 A.M. on 11/5/19. The Human Resource Business Partner said neither CPR nor First Aide training was required in the job description of the Nursing Assistant.

The Director of Regulatory Affairs was interviewed at 11:35 A.M. on 11/5/19. The Director of Regulatory Affairs said the Hospital had an initiative to ensure appropriate training for the Hospital's Nursing Assistants involved in restraint application and monitoring. The Director of Regulatory Affairs said the Hospital was working on a plan to have their Nursing Assistants CPR certified and provided the Surveyor with the Hospital's plan. The date to initiate the plan was in the upcoming weeks.
