Based on observations and interview with the Vice Chairman and Acting Emergency Medical Director during on-site investigation it was determined that the hospital failed to conspicuously display EMTALA information.

The findings include:

Code of Federal Regulations, Chapter 42 (42CFR) Section 489.20 (q) stipulates " In the case of a hospital as defined in ?489.24(b)-(1) To post conspicuously in any emergency department or in a place or places likely to be noticed by all individuals entering the emergency department, as well as those individuals waiting for examination and treatment in areas other than traditional emergency departments (that is, entrance, admitting area, waiting room, treatment area), a sign (in a form specified by the Secretary) specifying rights of individuals under Section 1867 of the Act with respect to examination and treatment for emergency medical conditions and women in labor; and ... "

On July 7, 2010 at approximately 10:15 AM, during an EMTALA investigation, a tour was conducted with hospital staff and members of the survey team of the Emergency Department's entrance, admitting area, waiting room and treatment areas. While touring the hospital emergency department, it was determined that the hospital failed to display the required EMTALA notification information (in a form specified by the Secretary) in the emergency department.
