Based on interviews with the hospital's Pharmacy Clinical Coordinator, Pharmacy Buyer, and the Contracting Manager; as well as conducting a review of Med-Pro Distributors, LLC invoice #3809, on September 5, 2014, it was determined that the hospital failed to be in compliance with State of Maine professional standards related to the health and safety of patients as outlined in Maine Pharmacy laws under "Title 32, Chapter 117, Section 13758.

The findings include:

1. Maine Pharmacy laws related to the health and safety of patients under "Title 32, Chapter 117, Section 13758, Licensure"; states "2. Licensure, manufacturers and wholesalers. All manufacturers and wholesalers whose products are distributed in the State of Maine must be licensed by the board."

2. The hospital received shipment of medications from Med-Pro Distributors with an order date of May 23, 2013.

3. Part of the shipment from Med-Pro Distributors was dispensed to the nursing units in the hospital, and was unable to be returned.

4. Review of Med-Pro Distributors, Maine Board of Pharmacy license, indicated that their license became active on July 23, 2014 and will expire on December 31, 2014. This became effective after the purchase date of May 23, 2013.

5. The Pharmacy Clinical Coordinator verified the purchase by hospital and distribution of the medications at the facility on September 5, 2014 at approximately 1040.
