Based on review of facility policy, observation and interview, the facility failed to post signs specifying the rights of individuals with respect to examination and treatment for emergency medical conditions and women in labor.
The findings include:
Review of the facility policy "Emergency Medical Treatment & [and] Active Labor Act (EMTALA) Guidelines" dated 12/2019 showed "...signage will be posted conspicuously in places where it is likely to be noticed by all individuals entering the Emergency and Obstetrical Departments, as well as those individuals waiting for examination or treatment..."
Observation and interview with the Quality Manager on 4/8/2024 at 8:50 AM, of the Main Lobby and Breast Cancer Entrance of the facility, revealed the required EMTALA signage was not visible on entry. The EMTALA signage was not posted outside the Main Lobby entrance, in the vestibule, or on any walls in the main lobby. During the interview, the Quality Manager confirmed the facility had a dedicated emergency department and the EMTALA signage was not posted in the Main Lobby and Breast Cancer entrance into the facility.
Observation on 4/10/2024 at 8:00 AM, of the Main Lobby and the Breast Cancer entrance of the facility revealed the EMTALA signage was not posted outside the main entrance, in the vestibule, or on any walls in the main lobby.
Observation and interview with the Senior Risk Manager/Regulatory Specialist on 4/10/2024 at 10:00 AM of the Main Lobby and Breast Cancer entrance of the facility revealed EMTALA signage was in the process of being placed in the vestibule of the main lobby of the facility.
