Based on observation and interview, the facility failed to post an EMTALA sign in all waiting areas likely to be noticed by all individuals that visit the Emergency Department (ED), resulting in the potential for all ED patients to not be informed of their rights to have a medical screening exam and stabilizing treatment in the ED. Findings include:
On 6/28/2021 at 1000 an observational tour of the ED was conducted. During the tour it was noted that there was only one EMTALA sign posted in the main ED waiting area of the hospital. An additional waiting area separate from the main ED lobby was identified during the tour of the ED area located near the registration and triage area. Observation of that area revealed the absence of an EMTALA sign within the additional waiting area.
On 6/28/2021 at approximately 1013, Staff A the ED manager was queried about the lack of an EMTALA sign within the additional waiting area. Staff A stated, "I thought there was a sign within this area. We will get that taken care of."
