Based on record reviews and interview, the facility failed ensure an allegation of physical abuse against a minor (Patient #1)by a facility staff member (Nurse #1) during a restraint was reported to local law enforcement in accordance with their abuse and neglect policy.
Findings included:
Review of facility incident report, dated 01/01/2025 at 5:00 PM revealed the following: Patient #1 reported to the physician the nurse had grabbed her hair and pulled her across the ground during a restraint the previous night. After video review, it was determined the nurse (Nurse #1) did utilize restraint techniques not authorized by CPI (Crisis Prevention Intervention). The staff involved was terminated after the video review was completed.
Review of facility camera timeline report, dated 01/01/2025, revealed but was not limited to the following:
"1639:59 - (Patient #1) attempts to jump over the nurse's station. Then scratching staff, verbal aggression continues.
1642:35 - (Patient #1) grabs staff badge off staff shirt, then throws badge back at staff.
1642:47 - (Nurse #1) grabs (Patient #1) by the arms, (Patient #1) attempts to get free of hold. (Nurse #1) then grabs (Patient #1) by the hair and pulls her to the ground.
1643:00 - (Nurse #1) can be observed with (Patient #1's) in her hand, holding her head on the ground with force.
1644:37 - (Nurse #1) falls to the floor due to (Patient #1) holding her leg. (Nurse #1) grabs (Patient #1) by the hair while attempting to get her leg free.
1645:00 - (Nurse #1) gets her leg free. Attempts to drag (Patient #1) into seclusion by her right arm unsuccessfully
Review of facility policy entitled "Reporting Abuse, Neglect & Exploitation, effective November 2010 and last reviewed and revised September 2024 revealed but was not limited to the following: "The adult patient has the right to make a police report. (Facility) is obligated to report any criminal act perpetrated upon a minor by staff to the (city) police department.
Review of email, dated 03/07/2025 at 2:45 PM from the Director of Performance Improvement confirmed that the Director of Risk Management failed to make a police report regarding the 01/01/25 1700 PM restraint described above.
