PATIENT RIGHTS: CARE IN SAFE SETTING

Based on record review and interview, 2 of 10 patients (Patients 9 and 10) did not receive care in a safe setting. Patient #10, known to be visually impaired and hard of hearing, was kicked in the face by patient #9.
Findings included:
1) Medical records review included patient #10 was sitting in the day room at a table. Patient #9 jumped on the table, lay down on his back and began to kick patient #10 in the face.
2) The incident report reviewed included patient #9, who was admitted to the facility 7 months prior to the incident, stated while in restraints after the incident, "I kicked a deaf, blind dude because his head looked funny."
3) In an interview with the surveyor the afternoon of 2/26/13, the Director of Quality Management confirmed the findings.
