Based on document review and interview, it was determined that the facility failed to comply with the requirements of 42 CFR 489.24 [special responsibilities of Medicare hospitals in emergency cases], specifically the failure to post EMTALA signs in areas likely to be noticed by all individuals that visit the emergency department (ED), see A 2402.

Based on observation and interview the facility failed to post EMTALA (emergency medical treatment and labor act) signs in areas likely to be noticed by all individuals that visit the emergency department (ED), resulting in all individuals entering the ED to be unaware of their rights. Findings include:
On 8/10/16 at 1100 during observational tour of the ED it was noted that there was no EMTALA sign posted at the ambulance entrance.
On 8/10/16 at 1115 Staff C and Staff F were asked if there was an EMTALA sign posted in an area visible to individuals who entered the ED through the ambulance bay. Staff F stated "It is posted on the other side where ambulatory walk in patients come in. Ambulance patients do not go through the other side, so they can't see it." Staff C stated "I do not see a sign posted on this side (ambulance bay)."
