PATIENT RIGHTS: NOTICE OF RIGHTS

Based on interview and clinical record review, it was determined the facility failed to issue the Medicare Important Notice prior to discharge to six (#9-12 and #14-15) of six (#9-12 and #14-15) patients. Failure to issue the second Medicare Important Notices did not allow the patients the opportunity to be informed of and aware of their rights as a hospital patient, as well as their discharge and appeal rights. The failed practice affected six (#9-12 and #14-15) of six (#9-12 and #14-15) patients. Findings follow:

A. Review of the clinical records for six (Patients #9-12 and #14-15) of six (#9-12 and #14-15) patients revealed no evidence the second Medicare Important Notice had been issued within 48 hours of discharge.
B. During an interview with the Patient Advocate/Quality Assurance/Risk Management Director at 0820 on 12/31/13, she stated there was not a policy and procedure addressing the Medicare Important Notice.
C. The Patient Advocate/Quality Assurance/Risk Management Director verified the above findings at 0830 on 12/31/13.
