Based on Record Review and Interview the hospital failed 1 of 1 Patient (Patient #1) by failing to ensure the patient has the right to be free free from all forms of abuse or harassment.
Findings Include:
During Record Review, the hospital Multidisciplinary Progress Note 03/26/2024, 8:55PM, "Patient #1 reported that he was attacked by peer while in the bathroom, but patient is unable to identify who the peer is."
During Record Review, the hospital Multidisciplinary Progress Notes 03/26/2024 at 8:55PM, "Patient #2 reports witnessing another patient (Patient #4) attack a peer (Patient #1)

During Record Review, The Shift Progress Note 03/26/2024 at 8:55PM, 'Peer accused Patient of attacking another Patient.' Patient #3 was describing Patient #4 attacking Patient #1.
During Record Review the Hospital Incident Log reflected 4 individuals listed on the log on the same housing unit at approximately the same date 03/26/2024 and same time 8:20PM. (Patient #1, Patient #2, Patient #3, and Patient #4).
During Interview with Hospital Staff #1 and Staff #6 on 04/09/2024, "The DON has been placed on suspension this morning. There is no way to contact the DON now, since being placed on suspension. Staff #6 was advised that there is no report of an investigation and the hospital is not following its own policy. Staff #6 had no further response. Videofootage was not provided for review as it relates to this incident."
Policy
The hospital Policy on Patient Rights dated 07/17/2019, reflected, "The rights, benefits, responsibilities, and privileges guaranteed by the constitutions and laws of the United States of Texas unless they have been restricted by specific provisions of law. The rights include, but are not limited to, the right to impartial access to and provision of treatment, regardless of race, nationality, religion, sex, ethnicity, sexual orientation, age, or disability; the right to petition for habeas corpus; the right to register and vote at elections, the right to acquire use, and dispose of property including contractual licenses, permits, privileges and benefits under law, the right to religious freedom and rights concerning domestic relations."
