Based on record review and interview the psychiatric hospital failed to ensure each patient/patient representative was informed of patient rights. This deficient practice is evidenced by failure to inform patient/patient' representative of patient's rights in advance in a language or manner non-English speaking Patients #1 and #2 could understand.
Findings:

Review of Patient #1's medical record revealed an admission date of 08/19/2024 with diagnoses Major depressive disorder and anxiety disorder.

Review of Biopsycholsocial Assessment dated 08/20/2024 revealed primary language was Spanish.

Review of Conditions of Admission and Consents dated 08/19/2024 at 12:22 p.m. failed to reveal evidence the psychiatric hospital used an interpreter/translator to assist with Patient #1's understanding and agreement with the acknowledgment of his rights as a patient, privacy rights, restraint rights, safe keeping of his personal property, and end of life decisions.

Patient #2
Review of Patient #2's medical record revealed an admission date of 08/07/2024 with diagnoses substance abuse, psychosis and anxiety.

Review of Psychiatric Evaluation dated 08/07/2024 revealed patient's primary language was Spanish.

Review of Conditions of Admission and Consents dated 08/07/2024 at 5:15 a.m. failed to reveal evidence the psychiatric hospital used an interpreter/translator to assist with Patient #1's understanding and agreement with the acknowledgment of his rights as a patient, privacy rights, restraint rights, safe keeping of his personal property, and end of life decisions.

In an interview on 09/24/2024 at 8:40 a.m., S2DON confirmed the above findings regarding Patient #1 adn Patient #2.

PATIENT RIGHTS: INFORMED CONSENT

Based on record review and interview the psychiatric hospital failured to use an interpreter/translator to assist non-English speaking patients #1 and #2 in understanding and agreeing with multiple consents found in the Conditions of Admissions and Consents packet.
Findings:

Review of psychiatric hospital's policy titled "Informed Consent", approved 01/2024, revealed in part: ... Consents shall be obtained by the patient or legal representative and placed in the patient's medical record for: treatment by psychiatric hospitalization, treatment by medical procedure, informed consent for medication, general nursing duty, restraint & seclusion, audio/video surveillance, patient identification photography, ineligibility of medication/drug possession, emergency agreement, transport release, personal valuables, bill of rights, assignment of insurance benefits, financial agreement, release of information, notice of advanced directives, privacy practices ...Procedure: Consent for psychiatric and medical treatment shall be signed by the patient or legal guardian at the time of admission and is valid for the duration of the current hospital admission.
