Based on a review of facility documentation, the governing body was not responsible for services furnished in the facility.
Findings were:
A review of facility policy #101 titled, "Abuse, Neglect and Exploitation " states, in part, "DEFINITIONS ...Abuse: Deliberate acts designed to cause physical or mental harm to another person can include pushing, slapping, making inappropriate comments, sexual abuse. "
A review of the facility training module titled "ABUSE & NEGLECT" states, in part, " Physical Abuse - physical act by a staff member that causes physical pain, suffering, injury or hurt to a patient, ...Verbal Abuse - Any derogatory, threatening, demeaning language whether in writing, oral or with gestures towards a patient. "
In a written statement by staff #1, he stated that he told patient #1 " If you hit me I ' m going to knock you out. "
The above was verified in a meeting with the Director of Nursing and Chief Executive Officer on the afternoon of 11-7-12 in the facility office.
PATIENT RIGHTS: FREE FROM ABUSE/HARASSMENT

Findings were:
In a written statement by staff #1, he stated that he told patient #1 " If you hit me I ' m going to knock you out. "
The above was verified in a meeting with the Director of Nursing and Chief Executive Officer on the afternoon of 11-7-12 in the facility office.
