Based on observation, interview, and document review the hospital failed to post conspicuous signs in the emergency department entrance and main hospital entrance specifying the rights of individuals under section 1867 of the Act with respect to examination and treatment for emergency medical conditions and women in labor (EMTALA.)

During observations on 10/7/19, at 12:00 p.m. it was noted that there were no signs related to the rights of individuals with respect to EMTALA at the ED entrance from outside or the main hospital entrance.

During an interview with Operations Manager (OM)-C on 10/7/19, she stated patients come through the ED door or the main entrance door to access the ED.

The hospital's EMTALA policy undated, and provided by hospital staff was reviewed. The policy did not include the signage related to EMTALA.

MEDICAL SCREENING EXAM

Based on interview and document review, the hospital failed to perform a screening examination to ensure a patient presenting for a condition that is not of an emergency nature, did not have an emergency condition for 1 of 22 patients reviewed (P11) when he entered the ED requesting a change of his feeding tube, but the patient waited over 1 hour without being seen by a provider or triaged by nursing staff and then left without being seen. Finding include:

Medical record review revealed P1 entered the ED on 9/1/19, at 5:23 p.m. requesting his feeding tube be replaced. Although the patient was registered by registration staff, there was no evidence that the patient was triaged by nursing staff or that the patient was seen by a provider and assessed to ensure he did not have an emergency medical condition. The patient left the hospital at 6:45 p.m. without being seen.

During an interview with nurse manager (NM)-B on 10/7/19, at 5:05 p.m., she confirmed that no triage was documented. She stated she would expect triage of this patient would have been completed and documented during the time frame he was at the hospital.

The policy titled Emergency Medical Treatment and Active Labor Act undated, was reviewed. Under Procedure the following was observed: 1. Mayo Clinic Healthsystem will provide every patient who comes to the ED with an appropriate Medical Screening Examination (MSE) to determine whether the patient has an emergency medical condition...
