Based on record review and interview the hospital was not in compliance with 489.24 in that the hospital was out of compliance with 489.24(a)(1)(i) medical screening exam.
Findings included:
On 05/22/22 at approximately 1600 Patient #1 presented to the hospital with an APOWW (apprehension by police officer without a warrant). The hospital did not perform a medical screening exam on Patient #1. The hospital refused to triage the patient.

Based on observation and interview the facility failed to maintain a central log on each individual who comes to the facility seeking assistance for 1 of 1 (Patient #1) patients, in that on 05/22/22 at about 1536 Patient #1 presented to the facility for treatment. Patient #1 is not listed on the facilities central log.
Findings include:
Incident Report, Irving Police Department dated 05/22/22 at 1536 reflected ..."I believed (Patient #1) to be a danger to herself placed her in handcuffs for an APOWW (apprehension by police officer without warrant) ...
(Patient #1) was then transported to Dallas Behavioral Hospital. Once at the hospital, Dallas Behavioral staff informed me they could not take (Patient #1) because they were on divert since they had no open beds. I replied I did not believe they were allowed to turn us (police) away when we arrived. The staff continued to refuse to take (Patient #1).
The intake log for 05/22/22 does not evidence Patient #1's name as presenting to the facility for treatment.
During an interview on 03/14/23 at 1105 Personal #1 verified Patient #1 was not listed on the EMTALA Log
The police titled EMTALA dated 07/29/22 reflected..."D Documentation. 1. All individuals presenting for emergency services shall be documented on the EMTALA Log..."

Based on record review and interview the hospital failed to perform the appropriate medical screening examination within the capability of the hospital's emergency department on 1 of 1 (Patient #1) patients, in that on 05/22/22 the hospital failed to perform a medical screening exam on Patient #1 when they presented to the hospital for treatment.
Findings included:
On 05/22/22 Patient #1 was brought the the hospital by police on an APOWW for suicidal ideation with a plan. The police report from the police department that transported the patient to the facility reflected..."05/22/22 at 1536 reflected ..."I believed Patient #1 to be a danger to herself placed her in handcuffs for an APOWW (apprehension by police officer without warrant) . I then notified Sgt (X).
Patient #1 was then transported to Dallas Behavioral Hospital. Once at the hospital, Dallas Behavioral staff informed me they could not take Patient #1 because they were on divert since they had no open beds. I replied I did not believe they were allowed to turn us (police) away when we arrived. The staff continued to refuse to take Patient #1...."
During an interview on 03/14/23 at 1215 Personnel #1 verified that the patients name was not on their intake log.
Review of the hospital's "EMTALA" policy dated 07/29/22 reflected, " ...Dallas Behavioral Healthcare Hospital shall provide triage for physical examination (Triage) and necessary stabilizing treatment and/or transfer to individuals as required by the Emergency Medical Treatment and Active Labor Act (EMTALA) ..."
