PATIENT RIGHTS: NOTICE OF RIGHTS

Based on observation and interview the facility failure to ensure the signage for patient rights and other required signage were present in the patient waiting rooms and bathrooms in the emergency department.
Findings Include:
Facility policy "Patient Transfer Policy (EMTALA and Texas Transfer Act Compliance) last reviewed 04/19/2023, stated: The hospital shall post a sign in the emergency department pursuant to ...stating the rights of individuals ....(the Emergency Medical Treatment and Active Labor Act) and stating whether the hospital participates in the Medicaid program.
Observation on 05/10/2023 at 1350 of the emergency department waiting room revealed no required signage related to patient rights and EMTALA was posted in the ambulatory entrance, ambulance entrance or waiting rooms.
Observation also revealed the sexual trafficking signs were not present in 4 of 4 bathrooms in the emergency center.
Interview on during the tour on 05/03/2023 at 1140, nurse manager (ID#54) validated the finding

Based on observation and interview during the tour of the emergency department (ED) on 05/10/2023 at 1415 revealed the crash cart in the trauma room #18 had not been consistently checked during the month of May.
Findings Included: The facility policy "Code Blue/Code Blue Crash Cart", publication date 02/23/2021 stated; 4. Code Blue Crash Cart Audit... is checked daily by trained personnel...
Observation of the ED on 05/10/2023 at 1415 of Trauma room #18, accompanied by staff revealed the crash cart had not been checked on May 02,06,09,10, 2023.
Interview with nurse (ID #56) who validated the findings, and stated "yes, its suppose to be checked daily".
