Based on interview, review of employee records, facility policy review, and review of State Law KRS 209.032, it was determined the facility failed to ensure the Kentucky Caregiver Misconduct Registry check was conducted for two (2) of two (2) sampled employees (Employee #1 and Employee #2).

The findings include:

Review of KRS 209.032 revealed the Kentucky Caregiver Misconduct Central Registry is to be checked on employees of state owned and operated psychiatric hospitals.

Review of the facility policy manual, revealed there was no documented evidence a policy had been written and established requiring the Kentucky Caregiver Misconduct Registry be checked prior to employment per KRS 209.032.

Review of the personnel file for Employee #1, revealed he was hired on 08/08/16. However, further review revealed there was no documented evidence the Kentucky Caregiver Misconduct Registry had been checked prior to employment.

Review of the personnel file for Employee #2, revealed he was hired on 01/03/17. However, further review revealed there was no documented evidence the Kentucky Caregiver Misconduct Registry had been checked prior to employment.

Interview with the Human Resources Director on 07/26/18 at approximately 10:32 AM, revealed he had no documented evidence the Kentucky Caregiver Misconduct Registry had been checked prior to employment for hospital employees except for the Security Guards. He stated he was not aware KRS 209.032 applied to hospital employees.
