Based on interview and record review the facility failed to follow their facility policy on Patient Rights/Responsibilities in 8 of a total sample of 10 medical records reviewed.

Review on 9/4/2019 of facility policy titled "Patient Rights/Responsibilities last reviewed 1/23/2019 revealed the following statement, "Upon registration, patients shall be informed via handout of his/her rights and responsibilities."

The facility's Consent for Treatment form had an area for a signature with a choice of two statements; "I have been given a brochure about my Patient Rights and Responsibilities, Notice of Privacy Practices, and Advance Directives" or "I do not want a brochure about my Patient Rights and Responsibilities, Notice of Privacy Practices, and Advance Directives." In 8 of 10 medical records reviewed (Patients # 1, 2, 3, 4, 6, 8, 9, 10) there were no signatures in these sections.

In interview on 9/4/2019 at 8:30AM with Director Medical Records/Registration G, he/she stated that registration received a "pop-up" if the Notice of Privacy Practices had not been obtained, "then they would ask for a signature." In reply to the statement in policy regarding Patient Rights Director G stated, "the brochures are on the counter but we don't routinely offer them to patients. I understand what you are saying and we will change our practice today and require a signature after one of the statements."
