PATIENT RIGHTS: FREE FROM ABUSE/HARASSMENT

Based on observation, interview and record review the facility failed to maintain a safe environment and keep patients free from harm.

Findings include:

Observation on 6/13/2017 of a hospital video dated 3/13/2017 revealed patient (ID #1) and staff member (ID #65) had a verbal and physical altercation. The staff (ID #65) pushed patient (ID #1) into the gym door per medical record Patient (ID #1) was sent to a nearby emergency room via ambulance and received six staples to his head. He was discharged back to the facility later that day.

Review of hospital policy titled Patient Rights and Responsibilities dated 10/21/2014 stated "The Patient's Bill of Rights shall include, but is not limited to, the patient's right to:
3. Considerate, dignified and respectful care, provided in a safe environment, free from all forms of abuse, neglect, harassment and or exploitation".
All hospital staff, medical staff members ... performing patient care activities shall observe these patient rights ".

Interview on 6/13/2017 at 0915 with the CEO (ID #53) stated "the patient (ID #1) kept on irritating the tech (ID # 65). The tech (ID # 65) pushed the patient (ID #1) on to the gym door and injury occurred to his head. We terminated him (ID #65) immediately".
