Based on observation and interview, the facility did not maintain a safe environment for patients (Central Receiving Center).
Per NFPA 101 Chapter 19.1.1.1.2 "This chapter establishes life safety requirements for all existing hospitals, nursing homes, and limited care facilities. The term hospital, wherever used in this code, shall include general hospitals, psychiatric hospitals and specialty hospitals." Additionally, under Title 42 CFR part 482.11, Compliance with Federal, State and local laws, (a) "The hospital must be in compliance with applicable Federal laws related to the health and safety of patients.
(b) The hospital must be (1) Licensed; or (2) Approved as meeting standards for licensing established by the agency of the State or locality responsible for licensing hospitals." And under 482.41 Condition of participation: Physical environment. "The hospital must be constructed, arranged, and maintained to ensure the safety of the patient, and to provide facilities for diagnosis and treatment and for special hospital services appropriate to the needs of the community. (a) Standard: Buildings. The condition of the physical plant and the overall hospital environment must be developed and maintained in such a manner that the safety and well-being of patients are assured." Per FAC 59A-3.081 Physical Plant Requirements for General, Rehabilitation and Psychiatric Hospitals. (11) Emergency Service Department "When 24-hour emergency service is to be provided, the following elements shall be required. (e) There shall be a treatment and examination room which shall have a minimum of 100 square feet of clear floor space and shall contain a work counter with storage cabinets, hand washing facilities and an examination light...."

Findings:

During the tour of the building on November 13, 2014 at approximately 11:30 a.m., the area designated as the Central Receiving Center (CRC) was entered and a room featuring signage designating the room as the Provider Office was entered. The room featured a patient examination table, a blood pressure cuff and an otoscope mounted on the wall. The room was occupied by a Nurse Practitioner. Interview with staff, at that time, revealed that the room was being used for patient exams. The room did not feature a hand washing sink and did not meet the minimum requirements for the minimum for 100 square feet of floor space. No actual measurement of the room was done but the room size was estimated by counting floor tiles that were one foot squares. Interview also revealed that the room was recently converted from an office and repurposed for patient exams.

These findings were reconfirmed with Senior Staff during the closing conference at 3:30 p.m. on 11/13/14.
