Based on observation, interview and policy review, the CAH failed to conspicuously post signs specifying the rights for examination and treatment of emergency medical conditions and women in labor; and conspicuously post signs whether the CAH participates in the Medicaid program under a state plan approved under Title XIX to all those entering the ED. Findings include:

During a tour on 4/16/24 at 1:59 PM of the ED, with the Chief Nursing Officer, ED Nurse Manager and Senior Director of Healthcare Quality, there were no signs posted in the ED waiting room and/or registration area specifying the rights for examination and treatment of emergency medical conditions, for women in labor, and/or for notification whether the CAH participates in the Medicaid program.

Per interview on 4/16/24 at 2:06 PM with the Chief Nursing Officer, S/He stated that the ED had been under construction since October of 2023 and confirmed that there were no signs posted in this area and should have been.

Per review of the policy "Emergency Treatment and Transfer"-last reviewed 4/2/24, it states, "The Emergency Medical Treatment and Labor Act (EMTALA) is law enacted in 1986 that governs when and how a patient may be: evaluated for emergency treatment; or transferred from one hospital to another ...I Policy...It is the policy of North Country Health Systems (NCH) to abide by EMTALA. The interpretation of this law is constantly in flux. Therefore, Emergency Department management, the Compliance Officer and Quality Assurance Department will ensure that compliant procedures are in place and are regularly reevaluated and followed."
