Based on observation and interview, it was determined that the facility failed to conspicuously post a sign specifying the rights of individuals under section 1867 of the Act in a location likely to be noticed by all individuals entering the emergency department (ED) and by the individuals in the waiting room waiting for examination and treatment.
Findings include:
Observation of the ambulance entrance to the ED on 12/28/2022 at 9:50 a.m. revealed no signs posted where it was likely to be noticed by all individuals entering the ED..
Observation 12/28/2022 at 9:55 a.m. in the ED waiting room revealed a three-sided information kiosk near the waiting room entrance. There was information pertaining to EMTALA rights posted on the side of the kiosk facing the wall.
Interview on 12/28/2022 at 9:55 a.m. with Staff E (ED Manager) confirmed the above findings. Staff E revealed the information kiosk had been moved and was not currently in its usual location.
Observation on 12/28/2022 at 12:30 a.m. of in the ED revealed no other signs specifying the rights of individuals under section 1867 of the Act.
