PATIENT RIGHTS: NOTICE OF RIGHTS

Based on observation, interview, and policy review the facility failed to inform the patient or patient's representative of the patient's rights in advance of furnishing or discontinuing patient care for 35 of 35 patients (#1 through #35) that came into the hospital as an outpatient through the Emergency Department. Findings include:

On 5/26/10 at approximately 1500 during a tour of the Emergency Department with the Administrative Assistant of Nursing Division the for Titled United Memorial Health Center / Kelsey Memorial Health Center Conditions of Admission" item #9 reveals "C.M.S. RIGHTS LETTER GIVEN TO PATIENT." Registration clerk # 1 queried regarding the form and stated that "I am unsure, I have the patient sign the consent form". Registration clerk #2 queried and stated "we don't have that letter to give to the patients." The Administrative Assistant of Nursing Division was queried and stated "we don't have that letter." This was confirmed by the Chief Nursing Officer (CNO).

On 5/26/10 at approximately 1515 during an interview with patient #1 when queried regarding receiving information regarding his patient rights he stated "They didn't tell me or give me anything"

On 5/27/10 at approximately 0900 while reviewing the facility's policy titled "Concern/Grievance Management" Policy #1.4, under the procedure section V. Patient Information read A. Upon registration or admission, patients are given a description of the concern/grievance process including whom to contact and how to submit a verbal or written concern/grievance to Spectrum Health United Memorial or the Sate as well as expected time frames for resolution of the concern/grievance." In addition, written in the immediate bulleted area was "The Patient Relations phone number is available in the Rights and Responsibilities brochure provided to outpatients." The CNO confirmed by stating "this is not happening".

On 5/26/10 and 5/27/10 during medical record review 35 of 35 medical records (patient #1 through #35) consisted of the form titled "United Memorial Health Center / Kelsey Memorial Health Center Conditions of Admission" and was signed by the patient with indicated that the facility gave the patient the C.M.S. letter. This letter was not being handed out to the patients, confirmed by the CNO and registration clerks #1 and #2.
