On the days of the EMTALA complaint investigation based on observations and interview, the hospital failed to ensure a sign was posted in its Emergency Department in a place or places likely to be noticed by all individuals entering the Emergency Department specifying the rights of individuals with emergency medical conditions (EMC) and whether or not the hospital participates in the Medicaid program.
The findings are:
On 03/31/14 at 1:05 p.m., random observations of the Emergency Department revealed there were no sign(s) posted specifying the rights of individuals to receive examination and treatment of an Emergency Medical Condition (EMC) or that the hospital participates in the Medicaid program. On 03/31/14 at 1:10 p.m., Staff Member 3 revealed that a sign was previously posted but must not have been replaced since the make over in the triage area.
On 03/31/14 at 1:20 p.m., Staff Member 4 confirmed the sign had not been posted after renovations were completed.
