Based on an observation at the North Tower, a door assembly does not meet required Standards in accordance with NFPA 101, chapter 19 and 7. The affected location is on the 7th floor at door #72C9. This condition would allow smoke and /or fire to enter adjoining spaces and endanger occupants.

Findings include:

While on tour April 28, 2010 at 11:00 a.m., the (1 and ? hour fire rated) cross corridor doors have a gap exceeding one-eighth of an inch at their meeting edges.

Reference: NFPA 80-Standard for Fire Doors and Fire Windows (1999 Edition) 2-3.1.7 " The clearance between the edge of the door on the pull side and the frame, and the meeting edges of doors swinging in pairs on the pull side shall be 1/8 inch +/- 1/16 inch for steel doors and shall not exceed 1/8 inch for wood doors. "

Based on an observation at the North Tower, wall construction is not in compliance with the minimum requirement in accordance with NFPA 101 chapter 19. A noted sample is on the 6th floor at an electrical equipment closet north of Room #6299. This condition would allow a fire to breach the space and make the exit corridor untenable.

Findings include:

While on tour April 28, 2010 at 1:00 p.m., an expansion of the closet did not include completion of the interior wall finish, to meet a fire rated assembly. There is no sheet rock applied to the steel wall studs above the door.

Following observation of fire rated closet doors at the North Tower, it was determined materials of a flammable nature were within their proximity in accordance with NFPA 101, chapter 19. The affected location is at the 8th floor Section #2 Staff lounge. This condition would allow a fire to accelerate quickly, jeopardizing occupants.

Findings include:

While on tour April 28, 2010 at 10:45 a.m., two communication equipment closets (one containing a fire alarm transponder unit) in the above described location, have clothing and additional personal belongings, hanging from "coat hook type brackets" attached to the door faces.

Based on an observation at the North Tower, dedicated exit corridors are not clear and unobstructed in accordance with NFPA 101 chapter 19. Sample noted locations are within the 10th floor Human Relations department, and at the 6th floor near room #6429. These conditions may impede a need for emergency evacuation in the event of a fire.

Findings include:

While on tour April 28, 2010 between 10:15 a.m. and 12:15 p.m., the corridor adjacent to store room #10-203 is blocked by a cart containing marketing materials. In addition, the exit path is routed through a foyer with cartons of indeterminate content, thus offering more obstructions. In the 6th floor corridor near room #6429, a rechargeable battery type floor refinishing machine is connected to a wall receptacle, a non-approved location for that function.

Based on observations and staff interview, cooking exhaust hood suppression systems are not in accord with required Standards NFPA 101 and chapter 9 and NFPA 96. Affected areas are at the main Kitchen of the North Tower and two locations in the South Tower. These conditions may cause a grease fire to be uncontrolled and endanger occupants of the spaces.

Findings include:

While on tour April 27, 2010 between 9:00 a.m. and 3:00 p.m., the North Tower suppression system is of a water-mist spray type. The servicing contractor has not included a drawing of the appliances and the relative nozzle locations on their most recent report. Physical observation revealed the appliances are not positioned in relation to the nozzle locations. Staff interview determined there are no spare nozzles on site. A representative minimum of 6 shall be provided in the same temperature range as those installed. If a fire was to occur, all cooking operations shall cease as the system could not be made operational again without the spare nozzles. In the South Tower, neither of the two suppression systems has received a servicing inspection performed since August 2009. At the 1st floor Kitchen, the exhaust hood has a moderate buildup of airborne debris coating the filters, thus diminishing their capabilities and increasing the potential for a fire. At the 3rd floor Terrace Market Cafe, one of the two exhaust hoods has a significant amount of grease laden debris coating the filters. At the "Wood Stone" open flame pizza oven, initial staff interview could not determine if a suppression system was evident. As a result, staff was instructed to cease all operations until the survey in to the concerns was concluded. At approximately 2:00 p.m., documentation and a physical inspection revealed that the oven does contain a suppression system. It is in combination with the two other hood suppression systems. At such time the unit was allowed to be re-ignited and put in use. The entire 3 cooking areas of the Cafe are all combined into a pre-engineered and installed system, which discharges the extinguishing agent wherever a fire may occur. However, there is no sign at the manual pull station to provide its function. A " K " type fire extinguisher is within close proximity, as an extra agent source should re-ignition occur.

Based on observations, portable electric heaters were evident. Sample noted locations are room #6554 and #6174. This condition may cause an uncontrolled fire to erupt and jeopardize area occupants.

Findings Include:

While on tour April 28, 2010 between 12:45 p.m. and 1:15 p.m., a heater of a non-approved type is in room #6554. It was not connected to a power source. In room #6174, a heater of an approved type was in use. However, facility policy #PM0406 prohibits portable electric heaters of any type.
