Based on observation and interview, the hospital failed to post conspicuously signages specifying the patient rights with respect to EMTALA in places likely to be noticed by all individuals entering the ED. This failure could result in patients being unaware of their rights for examination in the event of an emergency medical condition.
Findings:
On 1/20/15 at 0900 hours, a tour of the ED was conducted accompanied by RN Y.
The signages specifying the rights of individuals for examination and treatment with respect to emergency medical conditions and women in labor was observed to be posted on the wall in the waiting area before the triage booth and in the hallway by the ambulance entrance. However, there were no signages posted in the triage, registration, and all treatment areas.
On 1/20/15 at 0930 hours, RN Y and the CNO acknowledged the above finding. The CEO and ED Medical Director were also informed of the above finding on 1/21/15 at 1100 hours, during the exit conference.
