PATIENT RIGHTS: PERSONAL PRIVACY

Based on interview and record review it was determined the facility failed to protect one (1) of (10) sampled patients right to personal privacy (Patient #3).

The findings include:

Review of facility "Patient Rights and Responsibilities", dated July 2017, revealed the patient has the right to care in a safe setting and the right to privacy.

Record review revealed the facility admitted Patient #3 on 06/22/17 with diagnoses which included Traumatic Brain Injury, Seizure Disorder, and Impulse Control.

Interview with Patient #3 on 08/28/18 at approximately 12:00 PM, revealed while in the quiet room, Patient Aide (PA) #3 removed his/her sweatshirt over his/her head, and his/her tee shirt also came off leaving his/her bare breasts exposed. Patient #3 stated he/she had to cover his/her breast with his/her hands for about five (5) to ten (10) minutes until he/she was given another shirt to put on.

Interview with Registered Nurse (RN) #2 on 08/28/18 at approximately 9:14 AM, revealed she was on the unit when Patient #3 was in the quiet room. She stated she and RN #3 were removing a mattress from the quiet room so Patient #3 would not trip over the mattress and saw Patient #3 in the quiet room with his/her bare breasts exposed. RN #2 further stated she asked RN #3 why the patient's shirt was removed and was told it was to keep the resident cold; however, interview with RN #3 on 08/28/18 at 9:36 AM revealed he did not tell her that.

Interview with the Director of Nursing (Post Survey) on 09/13/18 at approximately 8:08 AM, revealed all patients have the right to privacy to the point it impedes safety.
