Based on document review and interview, the facility failed to ensure staff followed their policy/procedure for Patient Rights and Responsibilities for 1 of 10 closed medical records reviewed.

Findings include:

1. Policy/procedure PolicyStat ID: 3611038, Patient Rights and Responsibilities, revised/reviewed 5/12/2017 indicated on page 2: "St. Vincent identifies specific Patient's Rights and Responsibilities based upon the following processes and activities:... 5. Respects the patient's right to privacy".

2. Review of the Interdisciplinary Note-Nursing dated 7/15/17 at 1100 hours per staff N1 of patient 1's MR indicated: "...Informed Registered Nurse (RN) hospital supervisor and she/he along with security reported to the room...Requested to check phone for recording and deleted one photo of patient and one recording with no sound".

3. On 7/31/17 at approximately 1300 hours, staff N2 (Manager System Safety Consultant) was interviewed and confirmed security may request that a patient and/or family member discontinue taking photographs and video taping but staff should not request to look at a patient or family member's cell phone. Staff N2 confirmed security staff should not view and delete photos and/or videos from a patient or family member's cell phone. Staff N2 confirmed security staff should follow the policies/procedures for Patient Rights and Responsibilities.

4. On 7/31/17 at approximately 1500 hours, staff N3 (Risk Manager) was interviewed and confirmed facility staff should not view and delete photos and/or videos from a patient or family member's cell phone. Staff N3 confirmed facility staff should follow the policies/procedures for Patient Rights and Responsibilities.
