Based on document review, and interview the facility failed to ensure 5 of 21 patients (#13, #15, #17, #23, and #24) received the Important Message from Medicare (IMM) informing the patients of their rights, resulting in the potential that all medicare patients or their representatives at this facility will not have the information necessary for them to exercise their rights.
Findings include:
During medical record review on 6/22/2016 at approximately 0800 it was revealed that patient #13's medical record did not contain the second copy of IMM required to be given prior to discharge. During an interview with staff O on 6/22/2016 at approximately 0830 it was confirmed that the second IMM was not in the medical record. Staff O stated "I do not see that form on this chart."
During medical record review on 6/22/2016 at approximately 0900 it was revealed that patient #15's medical record did not contain the second copy of IMM required to be given prior to discharge. During an interview with staff O on 6/22/2016 at approximately 0930 it was confirmed that the second IMM was not in the medical record. Staff O stated "I do not see that form on this chart."
During medical record review on 6/22/2016 at approximately 00945 it was revealed that patient #17's medical record did not contain the second copy of IMM required to be given prior to discharge. During an interview with staff O on 6/22/2016 at approximately 1000 it was confirmed that the second IMM was not in the medical record. Staff O stated "I do not see that form on this chart."
During medical record review on 6/22/2016 at approximately 1015 it was revealed that patient #23's medical record did not contain the second copy of IMM required to be given prior to discharge. During an interview with staff O on 6/22/2016 at approximately 1030 it was confirmed that there was no IMM in the record. Staff O stated "I do not see that form on this chart."
During medical record review on 6/22/2016 at approximately 1045 it was revealed that patient #24's medical record did not contain the second copy of IMM required to be given prior to discharge. During an interview with staff O on 6/22/2016 at approximately 1115 it was confirmed that the second IMM was not in the medical record. Staff O stated "I do not see that form on this chart."
On 6/22/2016 at 1330 the Document titled "Medicare Notice" Dated 6/28/2013 was provided for review. "Procedure: ..Medicare Beneficiaries...when admitted to hospital as an inpatient... 1. the Medicare beneficiary must be provided a copy of "An Important Message form Medicare about your Rights" from the registrar...The signed copy should be placed in the medical record...#3 A second copy of the medicare notice must be provided prior to discharge."
