PATIENT RIGHTS: NOTICE OF RIGHTS

Based on a review of facility documents, medical records (MR), and interviews with staff (EMP), it was determined that the facility failed to provide Medicare beneficiaries with an Important Message from Medicare (IMM) within two days prior to discharge from the facility for 3 of ten medical records. (MR5, MR6, and MR17)

Findings include:

A review of facility policy revealed that the facility did not have a policy that addressed the Important Message from Medicare.

Review of MR5 revealed that the patient was admitted on January 7, 2017 and discharged on discharged on January 26, 2018. The review of the medical record did not reveal documentation that the patient received the second notice of the IMM.

Review of MR6 revealed that the patient was admitted on December 22, 2017 and was discharged on January 3, 2018. The review of the medical record did not reveal documentation that the patient received the second notice of the IMM.

Review of MR7 revealed that the patient was admitted on December 22, 2017 and discharged on January 3, 2018. The review of the medical record did not reveal documentation that the patient received the second notice of the IMM.

An interview conducted on May 9, 2018, at 1:30 PM, confirmed the IMM's that the facility did not have a policy that addressed the Important Message from Medicare and that the facility did not give a second notice prior to discharge.

Based on a review of medical records (MR) and interview with staff (EMP) it was determined the facility failed to ensure patients' right to have a family member or representative notified of admission to the hospital for 10 of 10 medical records reviewed (MR1, MR2, MR3, MR4, MR5, MR6, MR7, MR8, MR9 and MR10).

Findings include.

A review on May 9, 2018, of MR1, MR2, MR3, MR4, MR5, MR6, MR7, MR8, MR9 and MR10 revealed the patients were admitted to the hospital. There was no documentation in the records that indicated that the patients were asked if they wanted a family representative notified of admission to the hospital.

An interview on May 9, 2018, at 10:13 AM with EMP1 confirmed that there was no documentation in the records that patients were asked if they wanted their family representative notified of admission. Further interview with EMP1 confirmed there was no policy regarding family or primary care provider notification of admission.
