Based on observation and interview, the facility failed to post EMTALA signs in areas likely to be noticed by all individuals that visit the emergency department (ED), resulting in the potential for all ED patients to not be informed of their rights to have a medical screening exam and stabilizing treatment in the ED. Findings include:
During the observational tour of the ED, on 6/2717 at approximately 1030 - 1230, in was noted that there were no EMTALA signs posted in the following areas:
The Psychiatric ED had no signs posted in the triage room or treatment areas. The Adult ED had no signs posted in the triage rooms, main ED treatment areas, or ambulance entrance. The Children's and Women's ED had no signs posted posted in the triage rooms, main ED treatment areas, or ambulance entrance.
On 6/27/17 at approximately 1230, ED Administrator J was queried about the lack of signs and she stated, "We thought they only had to be posted in the admitting areas."
