A complaint investigation/abbreviated validation survey was conducted on 7/17/2018. Based on interview and record review, it was determined that the facility was not in compliance with Utah State nursing rules and laws. Specifically, the facility's surgical services was under the supervision and direction of a licensed practical nurse (LPN); supervision was outside the scope of practice for a LPN according to the Utah State Nurse Practice Act. The complaint was substantiated.
Findings include:
1. An interview was conducted on 7/17/2018 with the Chief Executive Officer (CEO) regarding the credentials of the supervising manager of the operating room. The CEO stated the operating room was supervised by a LPN.
2. Eight random hospital managers personnel files were selected for review. The Surgical Services Supervisor/Manager's current licensure was an LPN.
3. Review of the the hospitals organizational chart revealed that the LPN was listed as the operating room supervisor.
4. According to Utah state licensing rule R432-100-15. Surgical Services.1 (c) Qualified registered nurses shall supervise the provision of surgical nursing care.
5. In the Utah State Nurse Practice Act, section 58-31b-102, Licensed Practical Nurses cannot supervise a Registered Nurse. "Practice of practical nursing means the performance of nursing acts in the generally recognized scope of practice of licensed practical nurses as defined by rule and as provided in this Subsection (15) by a person licensed under this chapter as a licensed practical nurse and under the direction of a registered nurse, licensed Physician or other specified health care professional as defined by rule."
